Environmental Law Attorneys

Over the past three decades, federal, state, and local government agencies have placed increasing emphasis on environmental compliance and enforcement, forcing businesses to deal with issues of joint and several liability, cleanup expenses, civil lawsuits, and the threat of criminal and civil fines. Navigating the complex, and at times conflicting, requirements of regulatory agencies, legislative bodies and case law presents real challenges for companies and organizations. The Environmental Law Group at Dickie, McCamey & Chilcote has the knowledge and experience to guide your company through these issues, providing legal guidance and compliance programs to help you analyze, manage, and reduce the risk of environmental violations.

Our Group concentrates in enforcement programs, real estate and transactional services, civil litigation, criminal defense, and compliance programs.

Enforcement Programs

The Environmental Protection Agency, Department of Justice, and state regulatory agencies are actively engaged in uncovering and prosecuting violations of the Clean Air and Clean Water Acts, Superfund and Comprehensive Environmental Responsible Compensation Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA), Toxic Substance Control Act (TSCA), and Hazardous Substance Cleanup Act (HSCA). Because key members of our group started their legal careers with government enforcement agencies, they have years of regulatory experience and can offer insights into how the government conducts investigations and builds cases. This insight helps us respond strategically and quickly to alleged violations, helping to minimize penalties and costs for our clients.

Real Estate and Transactional Services

Transferring property and corporate assets can trigger retroactive liability, as can cleanup costs for pollution or spills occurring years before. The Group investigates potential liabilities in real estate and business transactions, and analyzes the cost of remediation to bring a site into compliance. We also assist with contract negotiation, zoning, insurance issues and permit acquisition, and can counsel multiple parties with collective responsibility for site cleanup.

Civil Litigation

Environmental civil matters can have severe consequences, ranging from personal injury cases, class action lawsuits, or government actions (including Superfund cases) to insurance defense — any of which can be enormously costly to the bottom line and to company morale. For public companies, civil matters also have the potential to erupt in stockholder lawsuits, which can result in personal civil penalties against key members of management and even the board of directors. The Environmental Law Group will strategically defend your interests should you or your company be taken to court or before environmental enforcement boards.

Criminal Defense

When the federal government perceives that civil proceedings might be too lengthy or lenient, it reserves the right to bring criminal charges against individuals and companies. Should criminal proceedings commence, our years of experience on the regulatory side in state and federal court cases provide the framework for us to build a strong defense on your behalf.

Compliance Programs

The United States Sentencing Guidelines (USSG) require that companies be fined treble damages if they do not have a compliance program in place when a federal law is violated. An effective, enforceable environmental compliance program offers protection because it is considered a good faith effort to comply with federal regulations. Moreover, the courts are authorized to treat companies leniently when a compliance program is in place. The Environmental Law Group can conduct a Compliance Audit to review your risk areas and company procedures to determine strengths and vulnerabilities, and develop compliance programs accordingly.
